Terms of Use

These Terms of Use ("Terms") govern your use of the Lingofisy mobile application, the Lingofisy website, and all related services, content, features, subscriptions and artificial-intelligence functionality (collectively, the "Service").

The Service is operated by:

("Lingofisy", "we", "us", or "our").

By creating an account, purchasing a subscription, or otherwise using the Service, you agree to these Terms.

Mandatory consumer rights under applicable law remain unaffected.

1. The Lingofisy Service

Lingofisy is a digital language-learning service focused on learning and practicing English.

Depending on your learning path, subscription and the current version of the Service, Lingofisy may provide features including:

• General English courses;
• Business English courses;
• IELTS preparation;
• vocabulary lessons;
• grammar lessons;
• quizzes and exercises;
• review and repetition functionality;
• learning progress tracking;
• XP, coins, streaks and achievements;
• AI-powered speaking practice;
• AI-generated corrections and language feedback;
• AI roleplays;
• pronunciation-related feedback where available;
• personalized exercises and mistake-repair activities;
• AI-generated tutor speech;
• animated tutor characters.

Some functionality is available only with Lingofisy Pro.

2. Eligibility

You must have the legal capacity required under applicable law to use the Service or must use the Service with the authorization of your parent or legal guardian where such authorization is required.

Lingofisy is not intended for children under 13 to create and operate independent accounts.

If you are a minor under the laws of your country, your parent or legal guardian must authorize your use of the Service where required by law.

Where applicable law requires parental consent for particular data processing or functionality, such consent must be obtained before the relevant functionality is used.

3. User Accounts

Certain functionality requires a Lingofisy account.

You agree to provide accurate information and to keep your account information reasonably current.

You are responsible for maintaining the confidentiality of your login credentials and for activity performed through your account unless caused by circumstances outside your reasonable control.

You must not:

• sell, rent or transfer your account;
• access another person's account without authorization;
• create accounts fraudulently or through automated systems;
• share your account for the purpose of circumventing subscription or security controls.

If you believe that your account has been compromised, contact support@lingofisy.com.

4. Free Tier

Lingofisy may offer a Free tier.

The Free tier may include functionality such as:

• language lessons;
• vocabulary;
• grammar;
• quizzes;
• review exercises;
• progress tracking;
• XP;
• coins;
• streaks;
• achievements;
• other learning functionality identified as Free within the Service.

The Free tier currently includes a one-time lifetime allowance of up to five minutes of AI speaking per user. This is a Free-tier allowance, not a subscription trial, and it does not renew or create an entitlement to continued Pro functionality.

5. Lingofisy Pro

Lingofisy Pro is a paid subscription.

Depending on the current version of the Service, Pro may include:

• Unlimited AI Speaking;
• personalized AI corrections;
• AI conversation practice;
• AI roleplays;
• personalized speaking feedback;
• advanced learning insights;
• personalized mistake-repair exercises;
• premium tutor functionality;
• premium speaking scenarios;
• Business English premium functionality;
• IELTS AI practice;
• other functionality clearly identified as Pro in the Service.

The exact Pro features available at the time of purchase are displayed in the application.

6. Unlimited AI Speaking

An active Lingofisy Pro subscription includes Unlimited AI Speaking.

For purposes of these Terms, Unlimited AI Speaking means that Lingofisy does not impose a fixed daily or monthly speaking-minute allowance on ordinary personal use of the AI speaking functionality.

Unlimited AI Speaking does not mean:

• unlimited automated requests;
• unlimited simultaneous AI sessions;
• permission to use bots, scripts or automated systems;
• permission to resell or redistribute AI access;
• permission to circumvent security or technical controls;
• guaranteed uninterrupted availability.

Lingofisy may use reasonable technical safeguards necessary to operate and protect the Service, including:

• per-request recording limits;
• request rate limits;
• concurrency limits;
• authentication controls;
• fraud detection;
• anti-bot systems;
• abuse-prevention mechanisms;
• security controls;
• temporary service-protection measures.

Lingofisy may also dynamically select AI models, shorten responses, summarize conversation context, use caching, use local processing or apply other technical optimizations.

Such technical optimization is part of operating the Unlimited AI Speaking service and does not itself constitute a fixed user-facing speaking-minute allowance.

We may temporarily restrict abnormal activity where we reasonably determine that the activity:

• is automated;
• constitutes abuse;
• is fraudulent;
• materially threatens the security or stability of the Service;
• attempts to circumvent safeguards;
• is substantially inconsistent with normal personal language-learning use;
• violates these Terms or applicable law.

Legitimate personal language-learning use is not subject to a fixed daily speaking-minute allowance.

7. Artificial Intelligence

Lingofisy uses artificial-intelligence technologies to provide features including:

• conversations;
• speech processing;
• language corrections;
• explanations;
• personalized exercises;
• speaking feedback;
• roleplays;
• tutor responses;
• generated speech.

AI systems are probabilistic and may make mistakes.

AI-generated content may occasionally be:

• incorrect;
• incomplete;
• inconsistent;
• inappropriate to the context;
• linguistically imperfect.

Lingofisy does not guarantee that an AI system will identify every language mistake.

Users should treat AI-generated feedback as an educational tool rather than as an authoritative professional assessment.

8. Pronunciation Feedback

Where pronunciation-related functionality is provided, the exact capabilities may depend on the technical implementation available at the time.

Lingofisy will not knowingly represent ordinary speech transcription as precise phoneme-level pronunciation assessment.

Where scores, estimates or automated pronunciation feedback are provided, they are intended as learning guidance and are not official language certificates or professional linguistic assessments.

9. IELTS

Lingofisy may provide preparation materials, exercises and AI practice related to the International English Language Testing System ("IELTS").

Lingofisy is an independent language-learning service.

Lingofisy is not an official IELTS examination provider and is not affiliated with, sponsored by, approved by or endorsed by the organizations that own or administer IELTS.

Any predicted performance, AI feedback or estimated band information provided by Lingofisy is for educational purposes only.

It is not an official IELTS result.

Only an authorized IELTS examination provider may issue an official IELTS result.

10. Educational Results

Lingofisy provides educational tools but cannot guarantee a particular learning outcome.

We do not guarantee:

• achievement of a particular CEFR level;
• a particular IELTS band;
• passing an examination;
• university admission;
• employment;
• immigration eligibility;
• improvement within a particular period.

Results depend on factors including the user's existing ability, effort, consistency and manner of use.

11. Subscriptions and Prices

Lingofisy Pro may be offered as a monthly subscription and an annual subscription.

The legally applicable price for an in-app subscription is the price presented to you by the Apple App Store or Google Play before you confirm the transaction.

Prices may vary between countries because of:

• local currencies;
• taxes;
• exchange rates;
• app-store pricing;
• regional pricing decisions.

Any price shown outside the final store purchase interface is informational unless confirmed by the relevant store at checkout.

12. Payment Processing

Mobile subscription payments are processed by the Apple App Store or Google Play.

Lingofisy does not receive your complete payment-card information from Apple or Google.

Your purchase may also be governed by the payment, subscription and platform terms of the store through which you purchased Lingofisy Pro.

13. Automatic Renewal

Unless expressly identified otherwise before purchase, Lingofisy Pro subscriptions automatically renew.

Your subscription will normally renew for the same subscription period unless you cancel before renewal in accordance with the rules of Apple or Google.

Subscription management is performed through the store account used for the purchase.

Uninstalling Lingofisy does not cancel a subscription.

Deleting your Lingofisy account also does not automatically guarantee cancellation of an Apple App Store or Google Play subscription.

If you no longer want the subscription to renew, you must cancel it through the relevant store.

14. Cancellation

You may cancel an auto-renewing subscription through Apple or Google at any time.

Unless applicable law or the relevant store provides otherwise, cancellation normally means that:

• future automatic renewal is stopped; and
• Pro remains accessible until the end of the period already paid for.

15. Refunds and Withdrawal Rights

Purchases made through Apple or Google are generally administered through the relevant store.

Requests for refunds may therefore need to be submitted to Apple or Google.

Nothing in these Terms restricts any mandatory:

• consumer rights;
• refund rights;
• warranty rights;
• statutory withdrawal rights;
• rights relating to digital services

that apply to you under applicable law.

Where applicable law grants you a right that conflicts with these Terms, mandatory law prevails.

16. Subscription Price Changes

We may change subscription prices prospectively.

Price changes for subscriptions purchased through Apple or Google will be administered in accordance with:

• applicable law; and
• the relevant store's subscription rules.

Where legally required, you will receive notice or be asked to consent to the new price.

A price change does not retroactively change an already-paid subscription period.

17. XP, Coins, Streaks and Virtual Items

Lingofisy may award virtual items including:

• XP;
• coins;
• achievements;
• badges;
• streaks;
• tutor cosmetics;
• outfits;
• profile cosmetics;
• other virtual rewards.

Unless explicitly stated otherwise, these virtual items:

• have no monetary value;
• cannot be exchanged for cash;
• are not cryptocurrency;
• are not stored-value products;
• cannot be sold or transferred;
• do not represent ownership of any financial asset.

XP primarily represents learning progress and achievement.

Coins may be used for cosmetic or gamification functionality made available within Lingofisy.

We may adjust reward amounts, balancing, progression requirements and virtual-item availability where reasonably necessary for product development.

We will not intentionally use such adjustments to remove a paid subscription entitlement during an already-paid subscription period.

18. User Content and Speaking Data

When using Lingofisy, you may submit content including:

• speech;
• audio;
• typed responses;
• conversation responses;
• answers to exercises;
• profile information.

You retain any rights you hold in your own content.

You grant us a limited, non-exclusive right to process that content only to the extent reasonably necessary to:

• provide the Service;
• process your speech;
• generate AI responses;
• provide learning feedback;
• save your learning history where applicable;
• personalize learning functionality;
• maintain security;
• prevent fraud and abuse;
• comply with legal obligations.

Personal-data processing is governed by our Privacy Policy.

You should avoid entering highly sensitive personal information into AI conversations where it is not necessary for language learning.

19. Acceptable Use

You must not use Lingofisy to:

• violate applicable law;
• exploit or endanger children;
• commit fraud;
• harass or threaten others;
• distribute unlawful content;
• attack or disrupt our infrastructure;
• introduce malware;
• gain unauthorized access to systems;
• bypass subscription systems;
• bypass AI cost or security protections;
• manipulate usage metering;
• scrape or systematically extract Lingofisy content;
• use automated bots against the speaking functionality;
• resell AI access;
• copy or commercially redistribute Lingofisy curriculum;
• reverse engineer the Service except where applicable law expressly permits such activity;
• misuse third-party intellectual property.

20. Intellectual Property

Except for content owned by users or third parties, Lingofisy and its original materials are protected by applicable intellectual-property laws.

Protected materials may include:

• software;
• application design;
• Lingofisy branding;
• logos;
• tutor characters;
• tutor artwork;
• animations;
• curriculum;
• lessons;
• exercises;
• text;
• audio;
• graphics;
• databases;
• original educational materials.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable right to use the Service for personal language-learning purposes.

No ownership rights in Lingofisy intellectual property are transferred to you.

21. Third-Party Services

Lingofisy relies on third-party services including services relating to:

• cloud infrastructure;
• authentication;
• artificial intelligence;
• speech processing;
• subscription management;
• payment processing;
• app distribution.

Third-party services may also be governed by their own terms and privacy policies.

The use of third-party providers does not remove any legal responsibility that applicable law places on Lingofisy.

22. Availability

We aim to make Lingofisy reliably available.

However, uninterrupted availability cannot be guaranteed.

The Service may temporarily be unavailable because of:

• maintenance;
• software updates;
• security incidents;
• internet failures;
• hosting failures;
• AI-provider outages;
• Apple or Google outages;
• emergency maintenance;
• circumstances outside our reasonable control.

23. Changes to the Service

We may update and improve Lingofisy over time.

For ongoing digital services, changes may be made for valid reasons including:

• security;
• legal compliance;
• compatibility;
• technical requirements;
• prevention of abuse;
• improvements to existing functionality;
• adaptation to changing technology;
• introduction or replacement of features.

Changes will not result in an additional charge unless you separately agree to purchase something.

Where applicable consumer law requires advance notice because a change materially and negatively affects your access to or use of an ongoing digital service, we will provide the required notice and any statutory termination rights.

24. Suspension and Termination

You may stop using Lingofisy at any time.

We may suspend or terminate access where reasonably necessary because of:

• serious or repeated violation of these Terms;
• fraud;
• payment manipulation;
• automated abuse;
• security attacks;
• unauthorized access;
• unlawful activity;
• material danger to the Service or other users.

Where appropriate and legally required, we will provide notice before termination.

Immediate action may be taken where necessary to protect security, prevent fraud, comply with law or prevent serious harm.

25. Account Deletion

You may request deletion of your Lingofisy account through the account-deletion functionality provided in the Service or by contacting support@lingofisy.com.

Account deletion and subscription cancellation are separate processes.

If you have an active App Store or Google Play subscription, you should separately cancel the subscription through the relevant store if you do not want it to renew.

26. Warranty and Statutory Rights

We provide Lingofisy subject to all mandatory statutory requirements applicable to digital services and consumer contracts.

Nothing in these Terms limits statutory rights that cannot legally be excluded.

AI-generated responses and automated educational assessments are inherently probabilistic. We therefore do not guarantee that every individual AI response or automated language assessment will be error-free.

27. Liability

We are liable without limitation where liability results from:

• intent;
• gross negligence;
• death, personal injury or damage to health caused by our fault;
• liability under mandatory product-liability law;
• an expressly assumed guarantee;
• any other liability that cannot legally be limited.

In cases of slight negligence, we are liable where we breach an essential contractual obligation whose fulfilment is necessary for proper performance of the contract and on whose performance you may ordinarily rely.

In such cases, liability is limited, to the extent permitted by law, to the foreseeable damage typical for this type of contract.

Otherwise, liability for slight negligence is excluded to the extent legally permitted.

Mandatory consumer rights remain unaffected.

28. Changes to These Terms

We may amend these Terms where objectively necessary because of changes to:

• law;
• regulation;
• the Service;
• security requirements;
• technology;
• third-party infrastructure.

Material changes affecting existing users will be communicated appropriately.

Where applicable law requires your consent to a change, we will obtain that consent.

Changes will not retroactively remove rights already accrued under an existing paid subscription.

29. Change of Business Operator

Lingofisy is currently operated by the individual identified at the beginning of these Terms.

If the Lingofisy business is later incorporated, transferred, reorganized or acquired, the Service and related contractual relationships may be transferred to a successor entity to the extent permitted by applicable law.

If this occurs, users will be informed where legally required.

A change of operator does not remove mandatory consumer rights.

30. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany.

The UN Convention on Contracts for the International Sale of Goods does not apply.

If you are a consumer habitually resident in another country, this choice of law does not deprive you of mandatory consumer protections applicable in your country of habitual residence.

Nothing in these Terms restricts a consumer's statutory rights regarding competent courts.

31. Severability

If an individual provision of these Terms is invalid or unenforceable, the remaining provisions remain effective to the extent permitted by law.

Mandatory statutory rules apply instead of any invalid provision where required.
